To the Defendants, Bertha D. Burnham and actual name unknown, Spouse, if any, of Bertha D. Burnham, whose last known place of residence and Post Office Address was 274 Broadway, Youngstown, Ohio 44502, but whose present residences are Unknown and cannot with reasonable diligence be ascertained.

Plaintiff has brought this action naming you as defendants in the above-named Court by filing its Complaint on the 6th day of May, 2002.

The object of the Complaint is to foreclose the equity of redemption under a mortgage against the following described real estate:

Situated in the City of Youngstown, County of Mahoning and State of Ohio:

And known as being Youngstown City Lot No. 12338, as recorded in Plat Volume 65, Page 265, Mahoning County Records.

Said Lot Number 12338 has a frontage on the north side of Broadway Avenue and extends back therefrom between parallel lines a distance of 272.5 feet, more or less, but subject to all legal highways.

PROPERTY LOCATION: 274 Broadway, Youngstown, OH 44502.

And for a judgment upon a promissory note executed to Charter One Bank, F.S.B. by Mark Mallen.

The relief demanded is a judgment against the defendant, Mark Mallen, in the amount of Fifty-eight Thousand Forty and 88/100 Dollars ($58,040.88), with interest thereon at the rate of 7% per annum from September 1, 2001, until paid, plus late fees; judgment for title costs, costs for protecting the real estate and for court costs; that said mortgage may be foreclosed and the said real estate described herein be sold at Sheriff's Sale and the proceeds of said sale applied for payment of plaintiff's claims; further that defendants, Stephanie Mallen; Bertha D. Burnham; Actual Name Unknown, Spouse, if any, of Bertha D. Burnham; Sky Bank, Successor to Mahoning National Bank of Youngstown; Metroplitan National Bank fka Metropolitan Savings Bank of Youngstown, etc., and Discover Bank, Issuer of Discover Card by Servicing Agt. Discover Fin. Svcs., Inc., be required to answer setting forth their claims or interests in the subject real estate, if any, or forever be barred from claiming or asserting same; and for such other and further relief to which plaintiff may be entitled.

You are required to answer the Complaint within Twenty-eight (28) days from the last date of publication of this notice, which will be published for six (6) successive weeks, said answer day being the 30th day of August, 2002.
