To the Defendants, Lebron C. Matthews and Ayesha M. Matthews, whose last known address was 525 Ferndale Ave. Youngstown, OH 44511-3207, but whose present whereabouts are unknown and cannot, with reasonable diligence be ascertained, will take note that on the 6th day of May, 2002, Sky Bank ("Sky Bank") filed its Complaint for Foreclosure ("Complaint") in the Court of Common Pleas, Mahoning County, Ohio where the same is now pending in Case No. 02CV 1340. The object of the Complaint is to foreclose on a mortgage against real estate owned by Defendants Lebron C. Matthews and Ayesha M. Matthews, referred to in Count Two of the Complaint and described as:
Situated in the City of Youngstown, County of Mahoning and State of Ohio and known as being Youngstown City Lot Number Twenty-three Thousand Two Hundred Sixty-five (23265) according to the latest enumeration of lots in said city, as recorded in Volume 21 of Plats, Page 23, Mahoning County Records.
Said lot has a frontage of Forty-five (45) feet on the South line of Ferndale Avenue and extends back on its west line One Hundred Thirty (130) feet, and on its east line One Hundred Thirty (130) feet, having a rear line of Forty-five (45) feet, as appears by said plat, subject to all legal highways.
Known for street numbering purposes as 525 Ferndale Ave, Youngstown, OH 44511-3207
PERMANENT PARCEL NO. 53-128-0-095.00
The relief demanded is for judgment agains Lebron C. Matthews and Ayesha M. Matthews in the sum of Twenty-two Thousand Six Hundred Seven and 35/100 Dollars ($22,607.35), plus interest at the rate of 9.2500% per annum from May 1, 2002, that the Mortgage be declared a valid and subsisting lien, that it be foreclosed, that all Defendants be required to set up their respective claims in or to the subject premises or be forever barred therefrom, that the equity of redemption be foreclosed, that all liens on the property be marshalled and that the property be ordered sold, that the proceeds of sale be applied in payment of the sums due Plaintiff including other costs expended herein and for such further relief as the Court deems just and equitable.
You are required to answer the Complaint within twenty-eight days after the last publication of this notice, which will be published once each week for six successive weeks, said answer day being the 20th day of August, 2002.
In case of your failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated, judgment by default will be rendered against you for the relief demanded in the Complaint.
