To: The Unknown Heirs, Devisees, Their Spouses and Creditors, Legatees and The Fiduciary the Estate, and Spouse, and Creditors of John J. Phelan, Deceased, you will take notice that on the 30th day of November 2022, Plaintiff, filed a Complaint for foreclosure in the Mahoning County Common Pleas Court, 120 Market Street, Youngstown, Ohio 44503, being Case No. 22CV 2122, alleging that there is due to the Plaintiff the sum of $35,418.08 plus interest at 8.61600% per annum from December 15, 2020, plus late charges and attorney fees applicable to the terms of a Promissory Note secured by a Mortgage on the real property, which has a street address of 296 Penhale Avenue, Campbell, Ohio 44405 being permanent parcel number 46-009-0-001.000.
Plaintiff further alleges that by reason of a default in payment of said Promissory Note, the conditions of said Mortgage Deed have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant is required to file an Answer on or before the 14th day of March 2023.
