To: Unknown Administrator, Executor or Fiduciary, Unknown Heirs, Next of Kin Unknown Spouses, Devisees, Legatees Creditors and Beneficiaries of Estate of Mary Ann Toney, Deceased, you will take notice that on the 15th day of October 2021, Plaintiff, filed a Complaint for Foreclosure in the Mahoning County Common Pleas Court, 120 Market Street, Youngstown, Ohio 44503, being Case No. 21CV 1856, alleging that there is due to the Plaintiff the sum of $61,645.66 plus interest at 3.99000% per annum from May 10, 2020, plus late charges and attorney fees applicable to the terms of a Promissory Note secured by a Mortgage on the real property, which has a street address of 4011 Euclid Boulevard, Youngstown, Ohio 44512, being permanent parcel number 53-196-0-012.
Plaintiff further alleges that by reason of the default in payment of said Promissory Note, the conditions of said Mortgage have been broken and the same has become absolute.
Plaintiff prays that the Defendant named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law.
Said Defendant is required to file an answer on or before the 22nd day of December 2021.
