By virtue of an Order of Sale issued from the Court of Common Pleas of MAHONING County, Ohio, and to me directed and delivered, I will offer for sale IN THE COMMISSIONERS' HEARING ROOM, Basement of the Courthouse, in YOUNGSTOWN, in said County, on

TUESDAY, JUNE 25, A.D. 2013

at 1:30 o'clock P. M. of said day, the following described lands and tenements, to-wit:

Situated in the Northeast and Northwest Quarters of Section 4, Township of Smith, County of Mahoning, State of Ohio and being further bounded and described as follows:

Beginning for reference at a County Monument found at the intersection of the centerlines of Bandy Road and North Benton-West Road, a 60 foot wide road;

Thence N 89°-37’-22” E with the centerline of said North Benton-West Road a distance of 3685.09 feet to the true place of beginning of the parcel of land herein described;

Thence N 0°-14’-00” W a distance of 42.27 feet to a 5/8 inch iron pin set, but passing through a 5/8 inch iron pin set at 30.00 feet;

Thence N 44°-24’-46” E a distance of 221.77 feet to a 5/8 inch iron pin;

Thence N 0°-14’-00” W a distance of 517.71 feet to a 5/8 inch iron pin;

Thence N 45°-18’-19” W a distance of 141.24 feet to a 5/8 inch iron pin;

Thence S 89°-37’-22” W a distance of 2415.23 feet to a 5/8 inch iron pin set on the grantor’s west line and the east line of a parcel recorded in O.R.V. 3319, Page 320, Parcel 4;

Thence N 0°-15’-17” W with the grantor’s west line, a distance of 1724.43 feet to a 5/8 inch iron pin set on the County Line and the grantor’s north line;

Thence N 89°-32’-56” E with said County Line and grantor’s north line, a distance of 2575.88 feet to the grantor’s northeast corner, said corner being S 0°-14’-00” E a distance of 2.41 feet from a 5/8 inch iron pin found;

Thence S 0°-14’-00” E with the grantor’s east line, a distance of 2545.14 feet to the grantor’s Southeast corner and the centerline of aforesaid North Benton-West Road, but passing through a 5/8 inch iron pin found at 2515.17 feet;

Thence S 89°-37-22” W with said centerline and grantor’s south line a distance of 215.84 feet to the place of beginning, containing 103.731 acres of land, more or less, of which 0.149 acres lies within the right-of-way of North Benton-West Road and being subject to all legal highways, rights-of way and easements

The above described parcel formerly being a part of parcels recorded in O.R.V. 3319, Page 320, Parcels 1 and 2, of the Mahoning County Records of Deeds.

The bearings cited herein are based upon an assumed meridian.

This description and survey of this property were made by David E. Vollnogle, Registered Surveyor No. 6958, in August 2003.

“V/L North Benton West Road, North Benton, Ohio 44449 (Parcel No. 16-188-0-003.05-0, 103.370 acres) is located on North Benton Road West (an east-west road). The intersecting road to the east is Co. Rd. 19 (Johnson Road) and the intersecting road to the west is Co. Rd. 17 (Bandy Road).”

AND BEING FURTHER KNOWN FOR STREET NUMBERING PURPOSES AS: V/L North Benton West Road, North Benton, Ohio 44449.

Bidding to begin at two-thirds (2/3) of appraised value.

Terms of Sale: Deposit in the form of a CERTIFIED CHECK for ten percent (10%) deposit of appraised value at the sale, ($3,000.00 cap on deposit for Plaintiffs), balance in full within thirty (30) days.

Sheriff's Sales may be canceled due to inclement weather or other county emergency. In such cases, the sale will be held upon the reopening of the Mahoning County Courthouse after the emergency has passed. Republication will not take place. However, notice of the new sale dates will be posted on the internet.
